If I sell my home in Türkiye, do I pay tax in the UK? Does pre-settled status change that?

Short answer

GOV.UK says that people who are UK resident for tax pay Capital Gains Tax when they sell property abroad. Relief can be claimed for double taxation. Tax residence is decided by days spent in the UK and ties, not by your visa or pre-settled status.

Who does this apply to?

  • This is general information, not financial advice or a personal tax calculation. It is for people living in the UK who are thinking of selling a home or land in Türkiye. It is based on GOV.UK pages; Turkish tax rules are not covered.

The UK side

  • GOV.UK says people who are UK resident for tax pay Capital Gains Tax when they dispose of overseas property, for example by selling it.
  • If the country where the property is also taxes the gain, you may be taxed twice. In that case you may be able to claim relief; GOV.UK says this is explained in a separate guide.
  • Special rules apply to UK residents whose permanent home (domicile) is abroad; the details are in the relevant GOV.UK guide.

What does "I'm here on pre-settled status" change?

  • Tax residence is decided not by immigration status but by the Statutory Residence Test. GOV.UK says it looks at days spent in the UK, your work pattern, your home and your family ties. The page does not mention visas or status.
  • So being pre-settled, settled or on another visa does not by itself decide your tax liability; but living in the UK often makes being treated as resident likely.
  • You can check with GOV.UK's residence status checker; it only gives an indication.

Points to watch

  • The gain is reported on your UK Self Assessment return; foreign tax may need extra pages. Check current allowances and rates on GOV.UK.
  • Tax may also be due in Türkiye; that depends on Turkish rules. See the Turkish Revenue Administration pages or an accountant.
  • Official pages change. This post is a general summary.
